Terms & Conditions

Please read these terms and conditions carefully before using our coliving platform. By accessing or using Nomadico's services, you agree to be bound by the following terms and conditions:


1. Definitions
1.1 "Nomadico" refers to the coliving platform operated by Nomadico Inc., including its website, mobile application, and any related services provided.
1.2 "Guest" refers to an individual who uses Nomadico's platform to book accommodations and participate in the coliving experience.
1.3 "Guest House" refers to the accommodation providers who list their properties on Nomadico's platform.
1.4 "Community Experience" refers to the services provided by Nomadico to enhance the social and professional interactions among guests, including events, workshops, and networking opportunities.

 

2. Use of the Platform
2.1 Eligibility: To use Nomadico's platform, you must be at least 18 years old and capable of entering into a legally binding agreement.
2.2 Account Creation: You are required to create an account to access Nomadico's services. You must provide accurate and complete information during the registration process and keep your account details up to date.
2.3 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account. Notify us immediately if you suspect unauthorized access to your account.


3. Booking and Payment
3.1 Booking: When making a booking through Nomadico, you agree to pay the specified fees for the selected accommodation and duration.
3.2 Payment: Nomadico acts as an intermediary for processing payments. You authorize Nomadico to charge the total amount of your booking to your designated payment method.

3.3 Payment in Some Locations:
3.3.1 Deposit: A portion of the payment, defined as the deposit, is required at the time of booking.
3.3.2 Balance Payment: For certain locations, the remaining balance of the booking must be paid via bank transfer to our Nomadico partners before the check-in date.

3.3.3 Special Conditions for Ahangama, Sri Lanka:
3.3.3.1 Initial Payment: 60% of the booking amount is required upon booking.
3.3.3.2 Remaining Balance: The remaining 40% must be paid via Wise, PayPal, or Bank Transfer more than two weeks before the check-in date.


3.4 Cancellation Policies:
3.4.1 Cancellation more than four weeks before the arrival date:
A guest who cancels their reservation more than four weeks prior to the arrival date shall be entitled to a refund of 100% of the deposit

3.4.1.1 High Season Cancellation Policy for Ahangama, Sri Lanka (1st November - 30th April): During the high season, if a guest cancels their reservation more than four weeks before the arrival date, the deposit will be refunded via a gift card. This credit can be used for a future stay at the same location.

3.4.2 Cancellation within four to two weeks before the arrival date:
In the event of a cancellation within the period of four to two weeks before the scheduled arrival date, the deposit shall be deemed non-refundable.

3.4.3 Cancellation less than two weeks before the arrival date:
If a guest cancels their reservation less than two weeks prior to the arrival date, the accommodation provider shall require full payment for the booking.
Furthermore, if the original booking is modified and results in a shortened duration within the two-week period before arrival, the guest shall be responsible for payment of the cancelled days.
3.4.4 In the event that a guest arrives but decides to depart earlier than the originally scheduled departure date, or fails to show up for the reservation, or cancels the booking after the arrival date, full payment will be required.
Please be advised that refunds may be subject to a 3% processing fee and/or influenced by currency exchange rate fluctuations, depending on the chosen payment method.

3.5 Transaction Fee for Refunds

3.5.1 Nomadico retains a transaction fee for processing refunds. This fee is variable and depends on the value of the original payment. The specific amount will be communicated to you at the time of the refund request.


4. Community Experience
4.1 Nomadico's Role: Nomadico is responsible for curating and organizing the community experience for guests. This includes planning events, facilitating workshops, and creating opportunities for networking and social interactions.
4.2 Guest Responsibility: Guests are expected to act respectfully towards fellow guests, guest house staff, and the local community. Any disruptive or inappropriate behavior may result in the termination of your stay and exclusion from future Nomadico experiences.
4.3 Event Participation: Participation in community events organized by Nomadico is voluntary. You acknowledge that engaging in any activities or events carries inherent risks, and you agree to assume full responsibility for any injuries or damages that may occur during participation.
Liability

 

5. Liability
5.1 Limitation of Liability: Nomadico acts solely as an intermediary between guests and guest houses. We do not own, operate, or control the accommodations listed on our platform. Nomadico shall not be liable for any damages, losses, or expenses arising out of or in connection with your use of the platform or any bookings made through it.
5.2 Indemnification: You agree to indemnify and hold Nomadico, its affiliates, and employees harmless from any claims, damages, or liabilities arising from your use of the platform, including but not limited to any violation of these terms and conditions.


6. Intellectual Property
6.1 Ownership: All intellectual property rights related to Nomadico's platform, including its website, mobile application, and content, are owned by Nomadico Inc. You agree not to reproduce, distribute, or modify any copyrighted material without prior written consent from Nomadico.

 

7. Modifications and Termination
7.1 Modifications: Nomadico reserves the right to modify or update these terms and conditions at any time. Any changes will be effective immediately upon posting on the Nomadico platform. It is your responsibility to review the terms and conditions periodically for updates. Continued use of the platform after any modifications constitutes your acceptance of the revised terms.
7.2 Termination: Nomadico may, at its sole discretion, suspend or terminate your access to the platform if you violate any of these terms and conditions or engage in any conduct that may be harmful to Nomadico, its guests, or guest houses.


8. Room Downgrading Policy
8.1 Downgrading Prohibited: Once a booking is confirmed for a specific room on Nomadico's platform, it is not allowed to downgrade your room to a lower category during your stay.
8.2 Price Adjustment: In the event that a guest attempts to downgrade their room after booking, Nomadico reserves the right to charge the same price that was paid for the previous room category. This charge will be equivalent to the original booking amount.
8.3 Upgrading Option: If a guest wishes to change their room to a higher category after booking, they may do so at an additional cost, subject to availability.

9. Data Sharing for Arrival Facilitation:
9.1 By accepting these terms and conditions, you are granting Nomadico permission to share specific information with our accommodation partners. This shared data may include your:

Name: To ensure the accommodation provider can identify and welcome you appropriately.
Contact Details: This includes your phone number and email address, allowing the accommodation partner to communicate important information regarding your reservation, check-in details, and any relevant updates.
Booking Details: Information related to your reservation, such as the dates of your stay, room preferences, and any special requests you may have made during the booking process.

9.2 Purpose of Data Sharing:
The primary purpose of sharing this information is to facilitate a smooth and efficient check-in process at the accommodation. By providing our accommodation partners with the necessary details, we aim to enhance your overall experience during your stay.

9.3 Confidentiality and Security:
Nomadico prioritises the security and confidentiality of your personal information. We ensure that any data shared with our accommodation partners is done in compliance with applicable data protection laws and regulations. Our partners are contractually bound to use the shared information solely for the purpose of facilitating your arrival and improving your stay experience.

9.4 Opting Out:
If, for any reason, you do not wish to have your information shared with our accommodation partners for arrival facilitation, please contact us at hello{at}nomadico{dot}io. However, please note that opting out may impact the efficiency of the check-in process and the overall quality of your stay.

9.5 Legal Compliance:
Nomadico is committed to handling your data responsibly and in accordance with relevant privacy laws. By accepting these terms and conditions, you acknowledge and agree to the outlined data-sharing practices for the specified purposes.

10. Pet Policy
10.1 Variability by Location: Please note that policies regarding pets, particularly dogs, may vary depending on the location of the accommodation.
10.2 Inquiry Required: If you intend to bring your dog or other pet with you, it is imperative that you inquire about the pet policy before making your booking.
10.3 Approval Process: Nomadico and the respective accommodation provider reserve the right to approve or deny requests for pets based on various factors, including but not limited to the pet's size, breed, behavior, and the specific rules of the accommodation.
10.4 Additional Charges: In some cases, bringing a pet may incur additional charges or require specific arrangements. These details will be communicated to you upon inquiry.
10.5 Non-Compliance: Failure to adhere to the pet policy, including bringing a pet without prior approval, may result in additional charges, termination of your stay, or exclusion from future Nomadico experiences.

11. Refer a Friend

11.1 Program Overview: Nomadico encourages our community to spread the word about our unique coliving experiences. Under our "Share The Love" referral program, existing users ("Referrers") can give their friends ("Referred Customers") a $20 discount on their first booking. When a Referred Customer mentions the Referrer’s full name at the time of booking and uses the discount code EXPNOMADICO, the Referred Customer will receive a $20 discount on their first stay, and the Referrer will earn a $20 credit towards their next stay at Nomadico.

11.2 Eligibility:
Referrer Eligibility: All current Nomadico users are eligible to participate as Referrers.
Referred Customer Eligibility: Referred Customers must be new to Nomadico, having never booked a stay before. Nomadico reserves the right to validate a Referred Customer's eligibility.

11.3 How to Refer:
Discount Code: The discount code to use is EXPNOMADICO.
Making a Referral: Spread the word to potential new users. Your friends need to book a room using the discount code EXPNOMADICO and mention your full name in the booking note, email, or WhatsApp message before their check-in date. You must have stayed with us before for the referral to be valid.
Credit Issuance: After your friend uses the discount code and mentions your name, they will receive a $20 discount on their first stay, and you will earn a $20 credit towards your next booking.

11.4 Usage of Credits:
Accumulation: Each new referral adds an additional $20 to your Nomadico credit.
Combining Credits: Credits can be combined with other ongoing discounts. However, the total discount for any booking must not exceed 25% of the total booking cost.
Credit for Couples: In cases where a couple books a single room, only the main booker is eligible to receive the $20 credit.
Non-Transferability: Credits are non-transferable and must be used by the Referrer or Referred Customer themselves.

11.5 Restrictions:
Self-Referral: A Referrer may not refer themselves under any circumstances (e.g., by using a different email address). Any attempt to do so will lead to the cancellation of the respective Nomadico credit.

11.6 Program Modification and Termination:
Right to Modify: Nomadico reserves the right to modify or terminate the referral program at any time, without notice, for any reason.
Right to Cancel Credits: Nomadico also reserves the right to cancel any awarded credits if any activities are deemed abusive or fraudulent.

11.7 Legal Compliance:
Compliance with Terms: Participation in the referral program must be in accordance with these terms and conditions. All participants agree to abide by the full terms of service as outlined by Nomadico.

12. Group Discount Program

12.1 Program Overview: Nomadico offers a Group Discount Program to encourage bookings by groups of three or more people. This program allows groups to enjoy a discount on bookings made for multiple beds or rooms, provided the group stays together for at least one week.

12.2 Eligibility:
Group Size: A minimum of three people is required to qualify for the group discount.
Booking Requirements: All bookings must be made by one person representing the group. This individual is responsible for booking the required number of beds or rooms (at least three) under a single reservation.
Duration of Stay: The group must stay for a minimum of one week. The start and end dates for each member of the group do not need to coincide, as long as there is a collective overlap of one week where all members are present.
Consumer Use: The Group Discount Program is intended for consumers only. Businesses seeking accommodations will receive a custom price tailored to their specific needs.

12.3 Discount Structure:
Group discounts are only available if at least half of the total nights booked fall within eligible months for group discounts. Check the eligible months for each Nomadico location here. See the discount structure below:

  • 3 people: 3% discount

  • 4 people: 4% discount

  • 5 people: 5% discount

  • 6 people: 6% discount

  • 7 people: 7% discount

  • 8 people: 8% discount

  • 9 people: 9% discount

  • 10 or more people: 10% discount

12.4 Additional Terms:
Eligible Months Definition: Nomadico defines eligible months for group discounts based on booking demand. These will be clearly stated on the Google spreadsheet provided and may be subject to change.
Discount Application: Discounts are applied to the total booking cost and are visible at the time of payment confirmation.
Combination with Other Offers: Group discounts can be combined with other promotional offers, provided the total discount does not exceed the limits set by Nomadico's promotional policies.
Non-Transferability: Group discounts are non-transferable.
Responsibility: The person making the booking is responsible for the accuracy of the booking details and ensuring that all group members adhere to the terms of their stay as per Nomadico’s policies.

12.5 Modification and Cancellation:
Changes to Booking: Any changes to the booking after confirmation may affect the discount eligibility and must be reported and adjusted through Nomadico’s customer service.
Cancellation: Standard cancellation policies apply. However, if the group size falls below the required number for a discount due to cancellation, the remaining booking will be recalculated without the group discount

12.6 Legal Compliance:
Compliance with Terms: Participation in the Group Discount Program must be in accordance with these terms and conditions. All participants agree to abide by the full terms of service as outlined by Nomadico.


By using Nomadico's platform, you acknowledge that you have read, understood, and agreed to the above terms and conditions, including the Room Downgrading Policy. If you do not agree with any part of these terms, please refrain from using the platform.
